Summary of the May 2021 NCA Assessment Policy Update
On May 19, 2021, the NCA (National Committee on Accreditation) introduced an updated assessment policy, which took effect on June 1, 2021. Here are the four main changes made to the policy:
5.1.2 & 7.3.1 - Local Learning Centre:
The policy now clarifies that individuals who completed a law degree through distance learning and attended classes at a local satellite learning centre cannot count the time spent at the local learning centre towards fulfilling the interactive learning requirement under subsection 7.2. In essence, time spent at a local learning centre is considered the same as distance learning for NCA assessment purposes.
7.2 - Interactive Learning:'
A significant update is found in subsection 7.2, which outlines the requirements for Interactive Learning." At least two-thirds of an applicant's law degree must be obtained through interactive learning. If interactive learning is not fully completed through in-person courses, then at least one out of three years must involve in-person instruction. The remaining third of interactive learning must provide opportunities for students to develop legal problem-solving and legal communications skills in at least 6 out of 8 components, which include various methods of assessment and access to online legal resources.
10.3.1 - New Legal Research Requirement:
Starting from January 1, 2022, applicants must fulfill a new legal research requirement. This can be achieved by taking a legal research and writing course with the Canadian Centre for Professional Legal Education (CPLED) or through an approved Canadian Common Law Program.'
13.4.1 - Request to Extend Validity Period:
Applicants have the option to request an extension of the validity period of their assessment beyond the standard five years. This request can be made either before or after the expiry of their assessment, and they must provide reasons justifying the extension. The Executive Director has the discretion to grant or deny the extension.
